LAND USE & DEVELOPMENT

Zoning

The Town of Marathon Zoning Ordinance (originally adopted September 17, 1970, amended February 11, 1992) divides the town into districts to regulate land use, building placement, and development. Local Law No. 2 of 2025 reflects the most recent amendments.

Agriculture

Major areas used for farming, forestry, and similar uses. Residential uses permitted with restrictions.

Industrial

Light and heavy industrial uses. Prohibits chemical production, junk yards, and rendering plants.

Residential (R-1)

Low-density residential use, with or without utilities. Includes single, two-family, and multiple family dwellings.

Flood Plain

Overlay district along the Tioughnioga River. No permanent structures without Board of Appeals approval.

Business

Centrally located retail and business areas including stores, banks, offices, and personal services.

Planned Development

Enables unified development of large tracts (25+ acres) with mixed uses approved by the Town Board.

Local Law No. 2 — Industrial rezoning

Seven parcels on Route 11 and McGraw-Marathon Road rezoned to Industrial District, including Square Deal Machining and Kurtz Truck Equipment properties.

1992

Zoning ordinance amendments

Updated mobile home definitions, minimum lot sizes, parking requirements, and penalty provisions. Zoning map revised along Highland Road and McGraw-Marathon Road.
